1. Acceptance

By accessing the Places application you agree to these Terms and all applicable laws. If you disagree with any part, discontinue use immediately.

2. Accounts & Security

• Sign in may be handled through Google or Facebook OAuth or via phone-based authentication using one-time passcodes (OTPs).
• You are responsible for maintaining the confidentiality of your sessions.
• Sharing accounts or attempting to impersonate others is prohibited.

Phone-Based Authentication

By providing a phone number you consent to receive one-time passcodes (OTPs) and other necessary account messages for authentication and account recovery. You are responsible for ensuring the phone number you provide is correct and authorized for your use.

3. Acceptable Use

• Submit accurate place information, reviews, and photos you have rights to share.
• Do not upload malicious code, spam, or unlawful content.
• Moderators and admins may remove content or suspend accounts that violate policies.

4. Content Ownership

You retain ownership of the content you upload but grant us a license to display it within the app. Removal requests can be submitted through the Data Deletion page.

5. Marketplace Disclaimer & Limitation of Liability

Platform Role: PlanetPointers operates as an intermediary platform that enables place owners and businesses to list their locations, services, and items. We do not own, operate, or control the listed places or businesses.

User-Generated Content: All place information, descriptions, items, prices, images, and other content displayed on the platform are provided directly by the place owners or users who have added them. We do not verify, endorse, guarantee, or take responsibility for the accuracy, completeness, quality, safety, or legality of any listings.

No Warranties: We make no representations or warranties regarding the places, items, or services listed on the platform. We do not guarantee that any place is operational, that items are in stock, that prices are current, or that any information is accurate.

User Responsibility: It is your sole responsibility as a user to:

• Verify the accuracy of all information before visiting a place or purchasing items
• Inspect the quality, authenticity, and condition of any items or services
• Ensure compliance with all applicable laws and regulations
• Exercise due diligence and caution in all interactions with listed places

No Liability: We expressly disclaim all liability for any damages, losses, injuries, or issues arising from:

• Your use of or reliance on any information provided by place owners or users
• The quality, safety, legality, or accuracy of items or services offered by listed places
• Any interactions, transactions, or disputes between you and place owners
• Inaccurate, misleading, or fraudulent listings or information
• Any harm caused by visiting, purchasing from, or dealing with listed places

By using this platform, you acknowledge and agree that all interactions with listed places are at your own risk, and you release PlanetPointers from any and all claims related to such interactions.

6. Law Enforcement Cooperation & Legal Hold

PlanetPointers complies with lawful requests from government and law enforcement authorities. If we receive a valid court order, subpoena, preservation notice, or equivalent legal process, we will:

• Preserve and provide the requested data to the extent required by applicable law.
• Pause or cancel any pending data deletion request for the affected account until the legal obligation is resolved (legal hold).
• Retain audit logs, login records, IP addresses, and activity data for as long as required by the legal process.

What this means for deletion requests: Submitting a deletion request does not guarantee immediate or irreversible removal of your data. If a legal hold is in place, deletion will be deferred. We will notify you that your request cannot be fulfilled at this time where permitted by law (we may be prohibited from disclosing the existence of a legal process).

This is consistent with GDPR Article 17(3)(b), DPDP Act 2023 Section 8(7)(c), CCPA Section 1798.105(d)(9), and analogous provisions in LGPD, PDPA (Thailand), and Australian Privacy Principle 11.

7. Service Changes

Features may change without notice. We may suspend or discontinue the service at any time. We are not liable for data loss resulting from user actions or external outages.
